What is a Regional Sponsored Migration Scheme Visa (Subclass 187)?

Work and live in Australia with this permanent resident work visa. Certain foreign-national skilled workers may be eligible for a Subclass 187 visa. This visa requires the applicant to complete a skills test and be nominated by an approved Australian employer for a job in regional Australia. Regional Australia does not include the Gold Coast, Brisbane, Newcastle, Sydney, Wollongong or Melbourne. There are three streams to this visa and applicants must also meet the requirements of the stream to be eligible.

What are the requirements to be eligible for the Regional Sponsored Migration Scheme Visa (Subclass 187)?

The Subclass 187 visa has three general requirements for all applicants and particular requirements depending on which stream you apply under.

The general requirements are:

  • Have been nominated by an approved Australian employer for a job in regional Australia
  • Are younger than 50 years of age, unless you are exempt
  • Meet the skills, qualifications and English language requirements, unless you are exempt

The Subclass 187 visa allows you to work in Australia under one of three streams:

The Temporary Residence Transition Stream

Temporary Residence Transition (TRT) stream

This stream is for workers who are currently in Australia on a temporary Temporary Work (Skilled) Subclass 457 visa. They must have worked for two years in the same occupation with their nominating employer who now wants to offer them a permanent position in that occupation. The employer must not be subject to a labour agreement and must have lodged a valid nomination with the Australian Department of Home Affairs (DHA) under the Temporary Residence Transition Stream.
The Temporary Residence Transition stream allows applicants who have held a Temporary Work (Skilled) visa Subclass 457 with the nominating employer to apply for Permanent Residence.
To be approved under the Temporary Residence Transition stream:
  • the nominating employer must:
    • continue to be actively and lawfully operating
    • have continued to meet the relevant training requirements
    • have complied with its obligations as a Subclass 457 approved sponsor
    • have no adverse information against it
  • the nominated position must:
    • be the same (or a closely related) position as was approved for the Subclass 457 visa
    • continue to be a genuine position
    • be a full-time position available for a minimum of two (2) years from the time the visa is granted
    • continue to meet the market salary rate and conditions (provide terms and conditions no less favourable than those afforded to Australian citizens and Permanent Residents in similar roles)
  • the visa applicant must:
    • have held a Subclass 457 visa to work in the nominated (or closely related) position, with the nominating employer, for at least the two (2) years prior to application
    • have at least Vocational English
    • meet relevant health and character requirements

Direct Entry stream

The Direct Entry Stream is for people who have never, or only briefly, worked in Australia. Temporary residents who hold a Subclass 457 visa and do not qualify for the Temporary Residence Transition stream may also apply under this stream. To be eligible, you must be applying directly from outside Australia. The Direct Entry stream allows applicants who do not meet the requirements of the Temporary Residence Transition stream to be nominated by an employer for Permanent Residence.
To be approved under the Direct Entry stream:
  • the nominating employer must:
    • be actively and lawfully operating in Australia
    • meet the relevant training requirements
    • have no adverse information against it
  • the nominated position must:
    • be a genuine position
    • be a full-time position available for a minimum of two (2) years from the time the visa is granted
    • be for an occupation listed on the Consolidated Skilled Occupations List (CSOL)
    • provide terms and conditions no less favourable than those afforded to Australian citizens and Permanent Residents performing similar roles
  • the visa applicant must:
    • be under 50 years of age
    • demonstrate Competent English
    • hold a successful skills assessment for your nominated occupation from the relevant assessing authority (unless exempted)
    • have at least three (3) years of highly relevant work experience
    • Meet relevant health and character requirements.

How can I apply for an Employer Nomination Scheme Visa (Subclass 187)?

Step 1: Check if you meet the all the requirements to work in Australia
You must meet both the general requirements of the Subclass 187 visa AND the specific requirements of the stream under which you are applying. The Subclass 187 visa allows you to work in Australia under one of three streams:
  • The Temporary Residence Transition stream
  • The Direct Entry Stream
  • The Agreement Stream

Step 2: Have Your Employer Lodge their Nomination
Before you can submit an application for the Subclass 187 visa your employer must lodge a nomination for you with the Australian Department of Home Affairs (DHA). You must apply less than six months after the nomination is approved.

Step 3: Prepare Your Documents
The Subclass 187 Visa requires you submit several documents with you application, in order to prove the claims made.

Step 4: Lodge Your Application Online
The Employer Nomination Scheme (Subclass 187) visa requires you to apply online. When you apply, you must have all documents ready as well as the visa application fee, which can be paid by credit card.

Step 5: Wait for a decision
It can take several months for the DHA to make a decision on your visa application.

Step 6: Receive your visa and start working
Once your application is approved, you will receive your visa and can start or continue working in Australia.

187 Visa FAQs

Who can nominate a skilled worker?

If you are nominating a skilled worker, you must meet the following criteria:
  • Actively and lawfully operate a business in Australia
  • Have a genuine need for a paid employee to fill a skilled position
  • Offer a skilled position in the applicant’s field that is full-time and ongoing for at least two years
  • Pay a market salary rate
  • Comply with Australian immigration and workplace relations laws
  • There is no adverse information known about your business or any person associated with your business.
If you do not have an employer who will nominate you, you can also submit an Expression of Interest through Skill Select. This will then allow prospective employers and State and Territory governments to view your details and then decide whether they want to nominate you.
The ENS allows you to add your partner and your children, stepchildren or your partner’s children or stepchildren, to your visa application. You will need to provide evidence of their relationship to you in your application and they must meet the relevant health and character requirements.
You can either be in or outside of Australia when you apply for a 186 visa. If you are in Australia however, you must hold a substantive or bridging visa.
There are circumstances where the Department will allow applicants over the age threshold to apply for this visa. These include if you:
  • are nominated as a senior academic (University Lecturer or Faculty Head) by a university in Australia
  • are nominated as a scientist, researcher or technical (scientific) specialist at ANZSCO skill level one or two by an Australian government scientific agency
  • are applying through the Direct Entry stream and you hold a Subclass 444 (New Zealand citizen) or Subclass 461 (New Zealand citizen’s family member) visa and you have been working for the employer who nominated you for at least two years in the last three years immediately before making the application
  • are applying through the Temporary Residence Transition stream, and you have been working for your nominating employer as the holder of a Subclass 457 visa for at least four years immediately before applying, and that employer paid you at least as much as the Fair Work High Income Threshold in each of the four years
  • are applying through the Agreement stream and the relevant labour agreement allows for a person who has turned 50 to be employed.
There are circumstances where you will not have to show that you have formal English language skills. These include:
  • If you hold a passport from New Zealand, USA, Canada, United Kingdom and Ireland
  • You are applying through the Transition stream and you have completed at least five years of full-time study in a secondary or higher education institution and all of the tuition was delivered in English.
Broadly speaking regional Australia includes anywhere in Australia, excluding the Gold Coast, Brisbane, Newcastle, Sydney, Wollongong and Melbourne.
